Marriage in Islam is deeply revered as a permanent bond rooted in mutual respect, love, and tranquility. To protect the sanctity of this relationship, Islamic jurisprudence has established strict guidelines regarding divorce, ensuring it is not treated frivolously. Yet, a controversial and widely misunderstood cultural practice known as "Hilla" (or Halala) marriage continues to surface, often blurring the lines between societal customs and actual religious doctrine.

The Reality of Pre-Planned ‘Hilla’

In conventional terms, a "Hilla" marriage occurs when a man divorces his wife three times (triple talaq) and then arranges for her to temporarily marry another man. This second marriage comes with a pre-condition: the new husband will divorce her shortly after, making her legally permissible to remarry her original husband.

In Islamic jurisprudence, a marriage contracted solely with the intention of making a woman lawful for her former husband is known as Nikah-ut-Tahleel. Islamic scholars, including Imam Kasani, have long clarified that orchestrating a marriage merely as a legal loophole contradicts the very foundation of matrimony. If a thrice-divorced woman genuinely marries another man, lives a normal domestic life, and the marriage ends organically due to unforeseen circumstances, she is free to remarry her first husband. However, treating the second marriage as a staged, temporary stepping stone is widely condemned.

The Scriptural Stance

The practice of pre-planned Hilla finds no backing in the Quran. Surah Al-Baqarah (Verse 230) outlines that a woman who has been divorced three times cannot remarry her former husband unless she marries someone else first. If that subsequent husband divorces her, the original couple may reunite. The crucial distinction here is intent. The verse refers to a genuine, bona fide marriage, not a transactional arrangement designed to bypass religious boundaries.

The Prophet Muhammad (PBUH) issued severe warnings against manipulating this law. According to traditions recorded in Sunan Abu Dawood and Jami` at-Tirmidhi, the Prophet invoked a curse upon both the Muhallil (the man who marries the woman to make her lawful) and the Muhallal Lahu (the first husband for whom the act is done).

Busting Common Myths

Several prevalent myths surround the Hilla process in various communities:

The "One-Day" Marriage: Some believe a marriage lasting a single day or night is sufficient to bypass the divorce rules. Authentic texts, including Hadiths from Sahih Bukhari and Sahih Muslim, explicitly state that a mere contract without a genuine, consummated marital relationship holds no legal weight for returning to a former spouse.

The Obligation to Divorce: There is a widespread misconception that the second husband is religiously obligated to divorce the woman. In reality, if a genuine second marriage takes place, the couple is encouraged to build a life together. The second husband bears no religious duty to end the marriage just to accommodate the former husband.

Consulting Experts Over Cultural Hearsay

Because the pronouncement of divorce carries profound legal and emotional weight, religious scholars advise couples to exhaust all avenues of arbitration and counseling before uttering the word. When disputes do escalate to a triple talaq, families are strongly discouraged from forcing women into staged Hilla marriages. Doing so is not only a violation of Islamic principles but is also recognized as a form of exploitation and oppression (Zulm).

Instead of relying on local cultural fixes or neighborhood advice, individuals facing complex divorce scenarios are advised to present the exact details of their situation to a qualified Mufti or religious scholar. Authentic religious verdicts (Fatwas) depend heavily on the specific context, wording, and timing of the divorce, ensuring that solutions align with faith rather than flawed cultural loopholes.

पैगंबर मुहम्मद (सल्लल्लाहु अलैहि व सल्लम) ने इस नियम का दुरुपयोग करने वालों को कड़ी चेतावनी दी है। सुनन अबू दाऊद और जामिअत-तिर्मिज़ी में दर्ज हदीसों के अनुसार, पैगंबर ने 'मुहल्लिल' (वह व्यक्ति जो निकाह को वैध बनाने के लिए अस्थायी निकाह करता है) और 'मुहल्लल लहू' (वह पहला पति जिसके लिए यह सब कराया जा रहा है)—दोनों पर लानत भेजी है।

  • "एक दिन" का निकाह: कुछ लोगों का मानना है कि तलाक़ के नियमों से बचने के लिए एक दिन या एक रात का निकाह काफी है। सहीह बुखारी और सहीह मुस्लिम की प्रामाणिक हदीसों में स्पष्ट किया गया है कि बिना वास्तविक और पूर्ण वैवाहिक संबंध (दाम्पत्य संबंध) के मात्र एक दिखावटी अनुबंध का कोई कानूनी मूल्य नहीं होता।

  • तलाक़ देने की बाध्यता: यह भी एक बड़ी भ्रांति है कि दूसरे पति पर महिला को तलाक़ देना धार्मिक रूप से अनिवार्य होता है। वास्तव में, यदि कोई स्वाभाविक दूसरा निकाह होता है, तो उस दंपत्ति को साथ मिलकर जीवन बिताने के लिए प्रोत्साहित किया जाता है। पूर्व पति की सहूलियत के लिए निकाह तोड़ने की दूसरे पति पर कोई धार्मिक बाध्यता नहीं होती।

सामाजिक अफवाहों के बजाय विशेषज्ञों की राय

चूंकि तलाक़ के शब्दों का गहरा कानूनी और भावनात्मक असर होता है, इसलिए धार्मिक विद्वान सलाह देते हैं कि तलाक़ के शब्द बोलने से पहले सुलह और मध्यस्थता के सभी रास्ते अपनाए जाने चाहिए। यदि विवाद तीन तलाक़ तक पहुँच ही जाता है, तो परिवारों को महिलाओं को जबरन दिखावटी हिल्ला निकाह में धकेलने से सख्त परहेज़ करना चाहिए। ऐसा करना न केवल इस्लामी सिद्धांतों का उल्लंघन है, बल्कि इसे एक प्रकार का शोषण और ज़ुल्म भी माना जाता है।

स्थानीय रिवाजों या आसपास की सुनी-सुनाई बातों पर निर्भर रहने के बजाय, वैवाहिक विवादों में उलझे लोगों को अपने मामले के सटीक विवरण किसी योग्य मुफ़्ती या आलिम के सामने रखने चाहिए। प्रामाणिक फतवे तलाक़ के विशेष संदर्भ, शब्दों और समय पर निर्भर करते हैं, जिससे यह सुनिश्चित हो सके कि समाधान कुरीतियों के बजाय सही धार्मिक नियमों के अनुरूप हो।
